CONDENSED TOS
NOTICE: This is the CONDENSED version of the TOS.Detailed info may be missing. The sole purpose of this condensed version is for the Customer to have an easy overview of the main points. Please refer to the full TOS below for more detailed terms, which WILL apply to your orders, and in some cases my art in general (16a, b and c).

TERMS OF SERVICE
LAST UPDATE: 18 June 2026This contract applies to the artist Fcomega121 further called Seller and person or institution further called Customer purchasing from Seller a work of art further called Product. By ordering Product from the Seller the Customer agrees to the following terms and conditions:PAYMENTS
1. Customer agrees to pay the due amount upfront for any orders.
2. On orders that can't be paid fully by customer at the given moment, customer agrees to pay half the invoice total upfront on approval of the initial sketch. The other half has to be paid once the product is finished, in order to get the final product
3. Any other payment schedule has to be mutually agreed before work on the Product commences.
4. Customer accepts that work on the Product will not commence until payment has been received by Seller according to the above schedule.
4b. If Customer chooses to change the size, amount of characters, etc. after agreed payment, there may be an adjustment of price to fit the value of Customer commission. Customer will be required to pay the difference in order to receive the product.
5. Certain types of work do not allow for a split payment such as pieces below or same as $18. In such cases customer will be informed about this and will be asked to agree on a different payment schedule, before any work can commence.PRODUCT DELIVERY
6. Customer agrees that Product will be delivered digitally in any social DMs or Email address provided by Customer, after the final payment has been received by the Seller.
7. Any other method of delivery, either digital or physical, has to be mutually agreed before the work commences. Customer is obliged to bear any costs incurred by alternative delivery method, such as postal costs, material costs, digital service subscription fees etc.
8. It is sole responsibility of Customer to propose delivery method which works for both parties. Seller cannot be held accountable for Customer's loss of access to the delivery method, loss of delivered files, impediments such as spam filters or any other technical obstacles outside responsibility of the Seller.
8b. Upon delivery of the product, it is the Customer's responsibility to store it properly. Loss of product due to negligence will not be reimbursed by the Seller. Seller can not guarantee that the original copy of the product will be available in the case that the Customer lost their files.REVISIONS
9. Customer has the right to three complete revisions in the sketching phase.
10. Customer has right to a reasonable amount of minor edits after completion, such as changing an eye color or fixing a small detail. Any requests above that, however minor, will require a prior mutual agreement and will result in a proportional increase of order value. Around +25% for major edits. Work on any such excessive and/or major requests will not commence until the payment for the additional price(s) has been received.CURRENCY CONVERSIONS
11. Customer agrees to pay the total amount specified in USD Dollars Or an equivalent amount in your local currency.
12. It is the sole responsibility of Customer to bear any currency conversion costs, bank transfer fees, payment provider service fees and any other costs involved in transferring funds to the Seller.
13. Payment is considered as received and completed only when total amount received on Seller's account USD Dollars (Converted to MXN after receiving) is equal to the accorded amount in USD Dollars or equivalent value in customer local currency.REFUND POLICY
14. Customer has right to request a full refund if there's been no progress for three consecutive months, or when Product has not been completed within four months. Refund conditions for commissions which require more work must be agreed separately, before the work commences. These provisions exclude work interruptions caused by unforeseen circumstances such as illness, accident or any other credibly documented reason for interruption of work.
15. Customer obliges to contact the Seller in a fast and responsive manner, responding swiftly to any requests for comments, clarifications, opinions, validation of progress etc. Lack of timely communication on behalf of Customer will be recognized as implicit approval of all work progress and current state of the Product to continue on.Any refunds, whether the already mentioned case or out of the blue will be corresponding: 100% refund Only during sketching phase, unless product is desired to be only a sketch, while cancellation during Lineart phase 60%, half completed art 50% and No refunds once at shading or when seller's almost up to fully complete the piece. DM art progress talk screenshots will be taken as protection against Chargeback run practices too.PERSONAL AND COMMERCIAL USE
16. The Product received by Customer is for Personal Use, Seller creations may be used for Personal cups, bags, t-shirts, and other products, with Seller permission. Customer may create these products with Seller art ONLY if that art was commissioned by the same customer, and have been granted permission by Seller, AND the products the costumer created are not for commercial use.
-Any use of the Product for Commercial Purposes, reselling it, reproduction or publishing for reasons other than personal purposes has to be approved beforehand by the Seller. This will require a separate agreement between Customer and Seller defining exact conditions and financial implications of such use of the Product, financial percentage value depending on the complexity of the piece, and/or number of pieces commissioned at once or under a tight deadline. thank you if you want my art for something big like this <316b. Customer and non-costumers does NOT hold the right to use the product or any art in any blockchain-related technology, including NFTs, cryptocurrency, or future inventions in the space; if such actions are done without explicit clear consent given from Seller (Fcomega121) person to person, corresponding actions will be taken, such as monetary compensation up to x50 (or more) the total product price. (One Example: a $40 product gets used into NFT/Blockchain/Crypto/etc, then the compensation will be of $2000 at least, or more if such action already got financial earns for example)16c. In addition, Customer and non-costumers does NOT hold the right to use the product or any art for AI datasets or for AI tools and any present or future inventions in the space; if such actions are done without explicit clear real consent by Seller (Fcomega121), and the Customer or non-costumer refuses to remove generations AND the artworks used to train any model, monetary compensations will be required at bare minimum of $127.75 USD (+$6.69 if it is NSFW ($134.44 USD)) for EACH AI piece regardless of quality, done with Fcomega121's art Style and/or with Fcomega121's Art within the training database for example. (I know AI generated content Needs of several re-generations to get something that looks good, the base compensation seems low, but remember each generation regardless of quality, will sum.)
If Customer or non-costumer doing such AI-Related actions with Seller Art, is unable or Unwilling on providing how many exact number of generations were done, an amount of x50 generations will be assumed per each published AI output ($6387.05 USD or $6722 USD if nsfw).
Even though other people's sues on ai haven't went through because supposedly the monetary loss "can't be calculated", Seller (I), however as established before, already know how much I'd lose by loss of social sharing distribution, the artwork results Seller (I'd) get paid for if certain ai piece/s were commissioned to Fcomega121 instead, with the same characteristics + tight deadline fee always added because of the fast (and often several) generation results can be translated to as extra work if the Seller had done it instead.
Also the Law doesn't recognize AI generations as copyright worthy anymore, so in special cases of need the Seller (I) can take back "what's mine" (that is to say: Any AI-generations that resemble of Fcomega121's Art, Art Style etc. and/or that have used Fcomega121's art in any way) by remaking such generations with real human art skills and use such human made remakes of them as however the Seller wants, to compensate financial loses from such practices.CANCELLATIONS
17. Seller reserves every right to refuse or cancel any order, under condition of refund, 100% refund Only during sketching phase, unless product is desired to be a sketch, while cancellation during Lineart phase 60%, half completed art 50% and No refunds once at shading or when seller's almost up to fully complete the piece, without giving reasons to Customer. (Unlikely to happen, but might happen at special circumstances such as:18. Any disrespectful behaviour will not be tolerated and may result in a cancellation of the order. Customer will receive full, partial or null refund depending on the amount of work completed and severity of behavior. Seller will have full right to refuse any service to the Customer in the future or charge $300 up front for emotional compensation for such disrespectful behaviors ^{(like a certain Demon-Bun I'll not mouth 💸 who was VERY disrespectful to me despite my work on several art pieces, without any payment... He knows who he is, And now I know who I am to not go through that again)...}
18b. Especially if such disrespectful behavior is related, but not limited to Racism, Latinophobia at seller, Homo/Trans/LGBTQ+phobias, threats, SA and/or Political/Religious extremism by traditionalist monotheist (or in very weird cases, polytheist) entitled behavior, like that one traditionalist Christian who called me a f* weirdo on one of my own art posts; Such evil behaviors from Customer will be Fully exempt of refunds by Seller, get blocked by Seller, and potential psa posts so other artists can avoid such toxic and harmful behaviors from any customer that acts like this.
